Federal trial opens for West Point cadet from Granger accused of distributing child porn

WHITE PLAINS, N.Y. (AP) — A West Point cadet is going on trial on charges of distributing child pornography.

Opening statements are scheduled for Tuesday morning in the federal case against Ricky Patrick Hester of Granger, Indiana.

Prosecutors allege that Hester, who has pleaded not guilty, sent videos to other Internet users that showed young boys engaged in explicit sexual activity.

Prosecutors say they have statements from Hester acknowledging to Homeland Security agents that he sent and received child porn.

Hester complained in court papers that the agents did not read him his rights or let him bring in an attorney. His lawyer tried to get the statements suppressed.

But the judge denied the motion, saying Hester was not in custody when he made the statements.

Hester has been on administrative leave since his arrest.
