INDIANAPOLIS (AP) — A transgender inmate is suing the Indiana Department of Correction commissioner over denied requests for hormone therapy.

The Indianapolis Star reports 55-year-old Anthony Loveday claims the department’s hormone therapy denials are a cruel and unusual punishment.

Loveday identifies as female and is represented by the American Civil Liberties Union of Indiana. The lawsuit says she experiences anxiety, depression and suicidal thoughts because of the denials.

The department’s policy is to provide therapy to inmates who received such treatments before their incarceration.

Loveday is housed at the Indiana State Prison in Michigan City. Records show Loveday is serving sentences for 2008 convictions of methamphetamine possession, unlawful firearm possession by a serious felon and child exploitation.

A department spokesman referred questions to the state attorney general’s office, which didn’t have immediate comment.

  1. Trust the state understands the implications of losing this battle and commits to fight hard. I do not want my taxpayer dollars being spent on this cultural issue. Identity politics, that liberals have endorsed, is draining this country and sparking unnecessary discord. An inmates’ life choices should not come at my expense.

  2. Agreed, Kevin. His name is Anthony. He is a male. These are not critical meds. They ARE recreational meds.

Keep this bs out of Indiana. ACLU is a bunch of racist freaks too.

  3. Why do “inmates” have any rights let alone the right to sue the state? Are we tax payers footing the bill for his\her attorneys for this nonsense? Why can’t we simply take this right away from incarcerated people? Even if this person is wealthy and could pay for this on their own it should not be allowed in prison…for any reason!

    • When you are convicted of a felony, you LOSE your rights. Period! The ACLU is sticking their nose where it does not belong! I do NOT want my tax money going to a serious felon for ANYTHING but incarcerating him. No special requests, no working the system to get tax payers to pay for ELECTIVE meds to change what he wants to be. IF you get out, pay for it yourself and stop stealing from taxpayers!
