Governor Holcomb has until Monday to announce his choice for Indiana’s next Supreme Court justice.

Under Indiana law, a nonpartisan nominating commission takes applications and conducts interviews — Holcomb’s pick must be one of the commission’s three finalists, who were announced in April.

Holcomb says the candidates’ judicial philosophies are his top consideration, but says in the aftermath of the COVID-19 pandemic, he’s also looking at the candidates’ ideas for helping the courts adapt to the new emphasis on using technology to make sure citizens can access government agencies and services more easily.

The finalists are Court of Appeals Judge Derek Molter, Grant Superior Judge Dana Kenworthy, and Supreme Court administrator Justin Forkner. Holcomb notes all three are between 40 and 50, underlining the long-term impact the selection will have. Justice Steve David, whose retirement announcement created the vacancy, has been on the court for 12 years, the longest of the five current justices.

Chief Justice Loretta Rush, who chairs the nominating commission, wrote Holcomb that all three finalists “are of a high caliber, and any of the three would be a lasting credit to the Indiana Supreme Court.”

It’ll be Holcomb’s second appointment to the court. All five justices were appointed by Republican governors, with one appointed by Mike Pence and two, plus David, named by Mitch Daniels.
