INDIANAPOLIS (AP) — Indiana’s high court has declined to take up the case of a couple who sought the destruction of millions of newborn blood samples stored by the state.
The suburban Indianapolis couple asked the Indiana Supreme Court in May to hear their lawsuit, but the five justices rejected that request Thursday.
The couple had sought the destruction of their 9-year-old daughter’s blood samples and those of some 2.5 million other people whose blood was collected as newborns for disease screening between 1991 and May 2013.
The Indiana Court of Appeals dismissed the suit in April after a trial court also dismissed it last year. Both found the girl was in no imminent danger of suffering harm by Indiana holding onto her blood and that of others after mandatory disease-testing was completed.
