Appeals court ruled wrongful death lawsuit against former South Bend officer can proceed

A wrongful death lawsuit can proceed against a former South Bend police officer, says a federal appeals court.

Former officer Justin Gorny ran a red light in his patrol car and crashed into Erica Flores’ car in July 2018. Flores was killed in the crash.

The Seventh Circuit Court of Appeals on Wednesday reversed a federal judge’s ruling that Gorny could not be held liable for Flores’ death.

Flores’ family sued Gorny and the city of South Bend, according to The South Bend Tribune.
