The Indiana Supreme Court says it will hear the case of a South Bend man convicted of murdering a toddler.

The court announced Monday it will hear arguments in the case of Tyre Bradbury, who was convicted to 60 years in prison for the 2014 murder of 2-year-old John Swoveland.

Bradbury, who was 15 at the time, was with Robert Griffin in a park, when they got into a gang-related fight with others. Griffin pulled out a gun and started shooting. None of the bullets hit his target, but did hit Swoveland, who was playing in a yard near the park.

Griffin was convicted of murder for shooting the gun, while Bradbury was found guilty of causing the boy’s death by bringing the gun. Six other people were also convicted on various charges for their roles in the fatal shooting.

However, last year, the Indiana Court of Appeals overturned Bradbury’s conviction, saying he received ineffective counsel.
