The Indiana Court of Appeals has reduced the sentence of a teen who was 13 when he shot and killed a man.

On September 2018, 13-year-old Alphonso James had arranged to meet 18-year-old Jaren Minies to trade a gun for an X-Box and $40 dollars.

Police say while the two were in the car making the trade, James, who was armed, grabbed Minies’ gun before firing nine shots a Minies from both guns.

Minies died on arrival to the hospital.

In January 2021, James was sentenced to 63 yeas in prison, however the sentencing guidelines call for between 45 and 65 years. 55 is the advisory sentence for a person under the age of 16.

James appealed, saying the trial court improperly rejected sentencing him as a juvenile. The court found that James’s age should have been taken into account. They resentenced him to the advisory sentence of 55 years.
