A settlement has been reached between St. Joseph County and the Kleven family for around $5 million.

After a deadly pond crash on University Drive in 2019, the family filed the lawsuit in 2021.

A four-year-old and a two-year-old were killed in the crash, and the driver, Brooke Kleven, and her three-month-old son were injured.

ABC 57 says the lawsuit was filed under the child wrongful death act alluding alleged reckless behavior by first responders.

The suit also criticized the handling of the 911 calls by dispatch.
