The legal battle over the South Bend Police tapes is headed to the Indiana Court of Appeals.

The South Bend Common Council has filed a notice of appeal after a St. Joseph County judge ruled last month that the recordings should be destroyed, saying they violated state and federal wiretap laws.

The recordings were subpoenaed by the council in 2012 during questions surrounding the removal of then-Police Chief Darryl Boykins.

Councilman Oliver Davis issued a statement, saying the appeal is about transparency and making the recordings public.
