OWI charges not to be filed against former bus driver

No criminal charges will be filed against a former Elkhart Community Schools bus driver accused of operating while intoxicated. 

The Elkhart County Prosecutor says key evidence is inadmissible because Department of Transportation testing procedures were not followed, and the breath test was not administered on a state-approved device.

According to WSBT, investigators found only one coworker who believed the driver smelled of alcohol, with no other witnesses reporting signs of impairment.
