WHITTEMORE, Mich. (AP) — Michele Compau just wanted to see lawn mower races in northern Michigan’s Iosco County. But what she got was a broken wrist and five subsequent surgeries after falling over a railroad tie.

The Michigan Supreme Court has ruled in favor of the Whittemore Inn Race Club in a dispute over responsibility for Compau’s injuries in 2010.

The state’s highest court last week reversed a decision by the appeals court, saying the railroad tie was “open and obvious” — a key legal standard in Michigan. Justice Richard Bernstein was the lone dissenter.

Compau says she fell while trying to avoid a lawn mower that was coming through a flexible fence. In her lawsuit, she argued that the race club had created an unreasonable risk of harm for spectators.
