While three Goshen and Elkhart police officers won’t face criminal charges in an incident in which gunshots were heard, there is fallout from the incident.

Goshen officer Brody Brown was charged in December with operating while intoxicated after another officer who was nearby heard the sound of gunshots.

Brown, Goshen officer Kyle Kalb, and Elkhart officer Leonard Dolshenko were all in the vehicle and off-duty at the time of the Dec. 14 incident.

The officers told police they couldn’t recall who shot the gun due to their level of intoxication.

Brown is serving 50 days without pay from the Goshen Police Department. Goshen Police Chief Jose Miller says Brown will have to take an alcohol education class and will have to have his driver’s license reinstated before going back to work.

Goshen Officer Kyle Kalb and Elkhart Officer Leonard Dolshenko were also in the vehicle at the time. Kalb has turned in his resignation. Goshen Police Captain Michael Miller has been demoted to patrolman. Goshen Lieutenant Mark Clere will serve 4 days suspension.

Elkhart County Prosecutor Vicki Becker says she couldn’t file charges related to the gunshots due to an “insufficient police response,” including a police failure to secure the truck’s officer-passengers and the vehicle to further the investigation.
