(Tommie Lee/95.3 MNC)

It’s been ruled a homicide. That’s what the the coroner is saying about the death of the man who police say suffered a medical emergency after getting into a struggle with authorities at the Clay Fire station at Bittersweet and Anderson Roads in Granger.

It was back in April when Brian DeBeck, 44, began to show signs of having a medical emergency after another struggle at the St. Joseph County Jail.

DeBeck was taken to Memorial Hospital where he later died.

Metro Homicide was still awaiting the autopsy report at midweek to review with other evidence.

Once their investigation is complete, the will be given to the St. Joseph County Prosecutor’s Office for a final determination.

I do not understand how this is ruled a homicide According to Indiana legal code a homicide is ” Code Sections Indiana Code Section 35-42-1-1: Murder
A person commits murder if he or she does any of the following:
Intentionally kills another human being
Kills another person while committing or attempting to commit arson, burglary, child molesting, consumer product tampering, kidnapping, rape, robbery, human or sex trafficking, carjacking, or narcotic or meth dealing or manufacturing (the “felony murder rule”)
Intentionally kills a fetus that has attained viability
