A Marshall County Sheriff’s Department Sergeant has been cleared of wrongdoing in a fatal shooting.

The County Prosecutor’s Office cleared Deputy Sgt. Matthew R Brown, saying he used his firearm in accordance with departmental and applicable state law. No criminal charges will be filed in this case, which was investigated by the State Police.

Dylan Bush was shot in November 2021 after a high-speed pursuit and an attempt by the suspect to hit the sergeant with his vehicle, according to the report. The prosecutor’s office report states Sgt. Brown believed deadly force was necessary to prevent serious injury to himself and that Bush’s refusal to stop was a risk that could endanger the lives of others if he was not apprehended.

The prosecutor’s office said any officer in a similar situation would have acted the same way.
