A Dowagiac man convicted in 2021 for being a felon in possession of a firearm has been re-sentenced to time served.
The case was remanded back to the county after a Court of Appeals ruling.
Michael Anthony Smith, 29, pleaded no contest and received credit for 707 days served.
Smith had originally been found guilty of possession of a weapon by a felon and use of a firearm in a felony and was sentenced to 1 to 5 years, plus an additional 2-year term.
Leader Publications reports the incident occurred on Jan. 6, 2021, during an argument with his girlfriend in a Dowagiac parking lot.
