A church pastor will be in court, Thursday, on charges of battery.
It was about two months ago when video surfaced of Pastor Martin Burns with his knee on top of a child at the Kingdom Kids Daycare in Winamac.
Pastor Burns says he was trying to get the kid to let go of his leg.
Court documents say Burns spent seven seconds with his knee on the child before he stood up. Now, he faces two battery charges, including one for battery against a person less than 14 years old.
Pastor Martin Burns is not in jail.
