City of Elkhart not negligent in 2017 crash killing three

A jury has ruled that the City of Elkhart isn’t at fault for a 2017 crash that killed three and injured two.
Shawn Wolcott, 22, Courtney Smith, 11, and Dolly Smith, 8 months, were walking along East Beardsley Avenue when a car veered onto the sidewalk, causing the fatalities.
The victims’ families sued, claiming the city ignored recurring issues at the Beardsley and Cassopolis Street intersection, failing to safeguard pedestrians or provide adequate warning signs for drivers.
The driver, Leonard Grosswiler, pleaded guilty to leaving the scene and is serving prison time. His wife also served time for helping conceal the car afterward.
