Hoosiers to Vote on Expanded Pretrial Detention Amendment

Indiana voters will decide November 3 whether judges should have broader authority to deny bail to defendants considered a serious public-safety risk.
The state constitution currently guarantees bail in most cases, with exceptions for murder and treason.
The proposed amendment would allow a judge to hold other defendants without bail if the state meets specific legal standards and shows release conditions would not adequately protect the public.
Supporters say the change would help keep repeat violent offenders in custody while they await trial.
Critics, including some defense advocates, say it could weaken due-process protections and leave people jailed for long periods before they have been convicted.
The proposed constitutional amendment has already been approved by two separate Indiana General Assemblies and now goes to voters statewide.
