Attorneys for Mike Pence prepared to argue against release of documents

INDIANAPOLIS (AP) — Lawyers for Vice President-elect Mike Pence are expected to argue that Indiana’s judicial branch has no authority to enforce his compliance with the state’s public records law in his current position as Indiana governor.

The Indiana Court of Appeals will hear oral arguments Monday in a civil case brought by attorney William Groth. He seeks documents related to Indiana’s participation in a successful legal challenge to President Barack Obama’s immigration executive order.

Groth sued Pence last year after he was denied documents under the public records law. A lower court previously ruled in Pence’s favor.

Pence’s lawyers argue the courts have no authority to interfere in the workings of the governor’s office.

Legal experts say a victory for Pence could strike a serious blow to the Indiana public records law.
