A motion to dismiss charges has been issued by an attorney in the murder of 6-year-old Grace Ross.

Anthony Hutchens is facing charges of murder and child molesting in the death of the girl.

The murder happened in New Carlisle in March 2021.

His attorney says that the charges against Hutchens should be dismissed.

Hutchens had previously waived a jury trial.

The state has 30 days to respond to the motion to dismiss.
