Gov. Whitmer not required to testify in abortion law suit

Governor Gretchen Whitmer will not have to testify in a lawsuit about the Michigan abortion ban.

This week, Whitmer’s attorneys will argue for a continued injunction against enforcement of Michigan’s 1931 abortion ban. On Wednesday a judge ruled that she will not be required to appear, according to Bridge Michigan.

A pair of Republican county prosecutors are seeking to enforce the law, and had subpoenaed the governor should have to testify since she’s the lead plaintiff in a suit challenging the ban.

Whitmer is not personally a party to the case, and is only a plaintiff in her official capacity as governor. The law in question would make it a felony for doctors or nurses to perform an abortion unless the mother’s life is in jeopardy.
