A lawsuit regarding the shooting death of a man in South Bend, failed in appeal court.

It happened in June 2019 in a parking lot in downtown South Bend.

ABC 57 News reports that Police Sergeant Ryan O’Neill told the man, Eric Logan, to drop the knife in his hand.

Logan allegedly did not drop the knife, so O’Neill fired two shots.

Logan was transported to the hospital, where he died.

Logan’s estate filed a civil lawsuit, saying that the sergeant used excessive force and violated equal protection laws.

That lawsuit was dismissed, so the estate appealed to the 7th Circuit, which ruled against Logan on Monday, October 3.
