A judge has dismissed a lawsuit filed by the South Bend Chocolate Company against the St. Joseph County Airport Authority.

The case was dismissed with prejudice, meaning it cannot be refiled. The company and owner Mark Tarner sued after the airport selected Sky Dine as its new concessionaire, ending a 10-year relationship.

The judge ruled the company had no legal right to renew its expired agreement, and the airport was not required to accept its bid.
