Zach Anderson to be resentenced Monday following sex with girl who lied about her age

ST. JOSEPH, Mich. (AP) — A 20-year-old Indiana man who spent 75 days in jail after pleading guilty to misdemeanor criminal sexual conduct for having consensual sex with a 14-year-old Michigan girl who lied about her age is scheduled to be resentenced.

Zach Anderson of Elkhart, Indiana, will be before a different judge Monday than the one who originally sentenced him. As part of that sentence, he would spend 25 years on Michigan’s sex-offender registry and register as a lifetime sex offender in Indiana.

Anderson’s lawyer successfully argued that prosecutors failed to remain neutral on part of the plea deal, which would have erased Anderson’s record if he stayed out of trouble. A Berrien County judge has ordered Anderson’s name removed from Michigan’s registry.

The girl, whom Anderson met online, told him she was 17.
