No criminal charges filed after reported sexual incident at Clay High School

No criminal charges will be filed into an alleged sexual incident that reportedly happened at Clay High School.

It was on February 21 that a 15-year-old girl reported the incident, which she said took place on February 13.

The St. Joseph County Special Victims Unit investigated the report, conducting interviews with the teen and her family.

The prosecutor’s office say the teen made it “abundantly clear that she was not sexually assaulted.”

The St. Joseph County Prosecutor’s Office released the following information about the investigation:

The St. Joseph County Special Victims Unit has concluded its investigation into an incident that included a 15 year old female student and multiple males that occurred on February 13, 2019, at approximately 5:30 p.m. on Clay High School grounds.

The incident was reported to the school principal, who then reported the incident to the School Resource Officer on February 21, 2019, as a possible sexual assault. A report was taken by the St. Joseph County Police Department and forwarded to both the Department of Child Services and the Special Victims Unit.

The SVU spent a substantial number of hours extensively investigating this matter, including interviews and consultation with the girl involved, her family, and reviewing electronic communication between the parties. The 15 year old female has made it abundantly clear that she was not sexually assaulted.

Based upon her statements and other evidence, it became clear that no criminal activity occurred. Therefore, no criminal charges will be filed in connection with this incident. Whether or not the activity violated any student code of conduct is left for the South Bend Community School Corporation to decide.
