A ruling in the more-than-six-year battle over the South Bend Police tapes will have to wait a little longer.
On Monday, March 18, a judge was expected to rule on a motion for summary judgement.
That decision will now be delayed to allow both sides of the case to establish their positions on consent.
State law only requires one person to consent to the recording, and there’s still a question about whether any of the people on the police tapes consented to being reported.
There was a failed attempt at mediation in the case last year.
The attorney for the South Bend Police has filed a motion for summary judgement, in an attempt to end the proceedings and keep the contents of the tapes a mystery.
