3 Indiana homeowners aim to limit Lake Michigan beach access

PORTER, Ind. (AP) — Lakefront property owners in a northwestern Indiana town are challenging the state Supreme Court’s ruling that guarantees public access to Lake Michigan beaches.

The Northwest Indiana Times reports the lawsuit was filed Thursday in a Hammond federal district court on behalf of Porter homeowners Randall and Kimberley Pavlock and Raymond Cahnman.

The suit seeks to repeal the highest court’s landmark 2018 Gunderson v. State ruling that the lake’s shoreline is open to all, and adjacent property owners can’t exercise exclusive control of the beach between their homes and the water.

The plaintiffs want the federal court to prohibit Indiana from enforcing it.

They should be able to have a little privacy. If you have a driveway, I’m sure you wouldn’t hesitate to call a tow service if someone parked in front of it. You must work as a male exotic dancer. I couldn’t see anyone hiring with that grammar…

Actually if they pay taxes on the (beach) then yes they have the say so on who uses it. And if people use it and they put up no trespassing signs you can be arrested on trespassing charges. That’s the law and I know how people now think the law doesn’t pertain to them.

This is a slippery slope. I think it’s important that the lakeshore belongs to the public who can then walk the beach unimpeded. People who buy lakefront property know this when they purchase the land. They do not pay taxes for the lakefront, all of us do!

QUESTION??? WHAT WAS THERE FIRST??? BEACH OR THEIR HOMES?? yep RIGHT THE BEACH!! SO WHY DID YOU BUILD WITH THE BEACH IN FRONT OF YOUR HOMES??? OH FORGET IT I KNOW THE ANSWER- YOU BUILD THINKING YOU COULD GET BY WITH WHAT YOU ARE ATTEMPTING TO DO – WELL I HOPE YOU LOSE~~

If the state of Michigan recognizes or have laws that say ALL people have access to the lake shore I hope these people lose their case. That is what is wrong with California and places out east. People seem to feel they have the right to own the shoreline because their house sets behind it. It is like the public right of way in front of our houses. We “own” it, probably pay taxes on it, have to maintain it but the city controls it. Same with easements in our backyards.
