A grand jury has issued indictments against two people in connection with the accidental deadly shooting of a 1-year-old boy in South Bend.

Javion Sexton passed away after investigators say a four-year-old sibling got ahold of a gun and fired. It happened back in June in the 600 block of Leland Avenue.

Arrest warrants were issued for two people in connection with the death.

Eboni Hosea, 23, turned herself in at the St. Joseph County Jail, last Thursday, on charges of neglect of a dependent resulting in death and several drug-related counts. She posted bail on Monday and has since been released. Police are still looking for Avion Sexton Sr., 23, who is wanted on more than a dozen similar charges.

Sexton is described by police as black, approximately 5’7” and 150 pounds.

The following information was released by the St. Joseph County Prosecutor’s Office:

On October 2, 2020, a grand jury issued indictments against two individuals in connection with the investigation into the fatal shooting of 1 year old Javion Sexton on June 18, 2020 (Leland Avenue, South Bend).

Avion Sexton, Sr., 23, was indicted on the following charges:

  • Count I: Neglect of a Dependent Resulting in Death a Level 1 Felony
  • Count II: Neglect of a Dependent Resulting in Serious a Level 3 Felony
    Bodily Injury
  • Count III: Neglect of a Dependent Resulting in Bodily a Level 5 Felony
    Injury
  • Count IV: Neglect of a Dependent a Level 6 Felony
  • Count V: Possession of a Narcotic Drug a Level 5 Felony
  • Count VI: Possession of a Narcotic Drug a Level 3 Felony
  • Count VII: Possession of a Narcotic Drug a Level 4 Felony
  • Count VIII: Dealing in Narcotic Drug a Level 5 Felony
  • Count IX: Dealing in a Narcotic Drug a Level 4 Felony
  • Count X: Dealing in a Narcotic Drug a Level 3 Felony
  • Count XI: Dealing in a Narcotic Drug a Level 2 Felony
  • Count XII: Possession of a Controlled Substance a Class A Misdemeanor
  • Count XIII: Possession of a Narcotic Drug a Level 6 Felony

Eboni Hosea, 23, was indicted on the following charges:

  • Count II: Neglect of a Dependent Resulting in Bodily a Level 5 Felony

  • Count III: Neglect of a Dependent Resulting in Serious a Level 3 Felony
    Bodily Injury
  • Count IV: Neglect of a Dependent Resulting in Death a Level 1 Felony
  • Count V: Possession of a Narcotic Drug a Level 6 Felony
  • Count VI: Possession of a Narcotic Drug a Level 5 Felony
  • Count VII: Possession of a Narcotic Drug a Level 4 Felony
  • Count VIII: Possession of a Narcotic Drug a Level 3 Felony
  • Count IX: Possession of Controlled Substance a Class A Misdemeanor

Based on the indictments, the St. Joseph County Circuit Court issued arrest warrants for
both individuals.

Eboni Hosea turned herself in at the St. Joseph County Jail on October 15, 2020, and was
booked into the Jail on this warrant. She appeared before a St. Joseph County Magistrate
on October 15th for her initial bail hearing and arraignment. At that hearing, bond was set
at $10,000 cash or $100,000 Corporate surety. She posted bond yesterday, October 19, and was released. Her initial hearing is scheduled for November 5, 2020 at 8:30 a.m. before Judge Hurley (cause number 71D08-2010-F1-000013).

Avion Sexton, Sr. has not been arrested on the warrant issued in this indictment (cause
number 71D03-2010-F1-000014). Authorities are asking anyone with information
regarding his whereabouts to call local law enforcement or Crime Stoppers at 574-288-
STOP. He is described as a M/B, approximately 5’7” and 150 pounds.

The sentencing range for a Level 1 Felony is 20 to 40 years. The sentencing range for a
Level 2 Felony is 10 to 30 years. The sentencing range for a Level 3 Felony is 3 to 16
years. The sentencing range for a Level 4 Felony is 2 to 12 years. The sentencing range for
a Level 5 Felony is 1 to 6 years. The sentencing range for a Level 6 Felony is ½ to 2 ½
years. The sentencing range for a Class A Misdemeanor is up to 1 (one) year.
