Elkhart man’s 78 year sentence on sexual battery, armed burglary charges ruled too harsh

The Indiana Court of Appeals has ruled that an Elkhart man’s 78-year sentence after pleading guilty to armed burglary and sexual battery is too harsh.

Michael Middaugh Sr., 51, was sentenced in September after pleading guilty to burglary and criminal confinement while armed with a deadly weapon, as well as sexual battery under threat of deadly force. He also admitted to being a habitual offender.

The charges stemmed from an attack on an elderly woman at her home in Bristol. He received a total sentence of 78 years, which includes 50 years in prison and the remaining time suspended, as well as a lifetime on probation.

Middaugh appealed and the state ruled in his favor. They also agreed with the State of Indiana’s request that he be remanded for resentencing, after admitting that the trial court erroneously sentenced Middaugh in a way that violated the terms of his plea agreement.

Yet another justice system failure! Dangerous criminals being relieved of accountability because of harsh sentencing! He got his break by only having to do 50 of 78 in prison.

This MONSTER should never see the light of day outside of that prison! It’s a slap in the face to the victims having to live with the God awful tormenting nightmares caused by this pos! He is facing way more charges in Marshall County! That’s why he is pushing this. Just putting off what’s coming for him! What will it take to get the punishment to fit the crime??He should get life with no possibility of parole! You list in this article that he admits to being a habitual offender, well who gives 2 sh!&$.. There is no denying what’s on his record!

Get rid of those who said it was to harsh
Judges , parole board, review board .
What is their names? It should be posted ! Also to get these clowns out of a job.
This guy is life in prison for sure!

No, not life…death. Why should we pay to provide food and shelter for things that can not be trusted in society?
