A man who claims he tripped twice with his six-month old child, twice landing on top of him, has been arrested. Asiah Molik was found by his grandmother Jan. 27. He was pronounced dead at the hospital. St. Joseph County Prosecutor Ken Cotter said in a Thursday press conference, that Averius Molik was arrested Wednesday night.

Molik is charged with four counts of neglect of a dependent, but is not directly charged in the child’s death.

“Asiah was then taken to a forensic pathologist who conducted an autopsy,” said Cotter. “A number of forensic pathologists have reviewed those results and they cannot determine the manner or cause of death.”

The child had 23 fractures, some of them refractured, said Cotter. Molik explained that to police by saying that he had tripped down the stairs and fallen on his child, then did so again later.

Cotter said that doctors could not rule that out as a possible explanation.

“Mr. Molik also advised us that he sought no medical treatment, sought no attempts to help Asiah,” said Cotter. “Doctors told us that every time someone would pick up Asiah, that Asaih would feel the pain from those fractures.”

Cotter said Molik is not directly charged with the child’s death because the forensic pathologists have not been able to determine if the death was intentional.

“Those significant injuries, most people would think, shoot, that had to have caused the death. We rely on our experts to be able to tell us whether or not those injuries are associated with the death and they cannot do so,” said Cotter.
