Several people have wondered why the son of Mishawaka’s Mayor was released from custody just a few hours after the alleged OWI crash he was involved in.
While some believe his quick release was because of special privilege, it turns out the early release in his face is actually part of the local criminal code.
Rule 26 on pre-trial detentions, says those arrested on misdemeanor Operating While Intoxicated with no prior convictions are released when their blood alcohol level drops below .05.
When Wood was booked into the St. Joe County Jail late Saturday night, he registered .07.
When he was released a few hours later, he had already dropped below the lock-up level.
Wood is charged with a misdemeanor count of operating a vehicle while intoxicated endangering a person.
He’s due in court on Nov. 20.
