An Elkhart man facing a murder charge after a child died in his care will undergo competency evaluations.

Police responded on December 16 after a 20-month-old was hospitalized with severe injuries, including a skull fracture, brain bleeding and liver damage.

The child was left with 21-year-old Miguel Garcia, who was in a relationship with the child’s mother at the time.

Garcia and the child’s mother claimed the child had fallen on December 13, but medical experts stated that the injuries were inflicted and not accidental. The child died on December 20 with his death ruled as homicide.

The Goshen News says Garcia’s competency is under evaluation with his trial currently set for May 19.
