A man serving a 35-year sentence for conspiracy to commit murder and attempted murder is seeking post-conviction relief.

35-year-old Devarious Cantrell has served about a third of his sentence. His earliest possible release date is listed as May 2028.

On Thursday, the judge agreed to hold an evidentiary hearing on December 17 for Cantrell and his attorney to argue for a sentence modification.

Cantrell was convicted in connection with a 2012 shooting in Elkhart, where police said he shot a ban in the legs. The Goshen News says his co-defendant Jose Pena was released from prison earlier this year.
