Elkhart man accused of murder seeking additional competency evaluation

An Elkhart County judge has denied a second request to evaluate the competency of an Elkhart man charged with murder in the death of a 20-month-old child.

Defense attorneys argued Miguel Garcia’s condition has worsened in custody, citing seizures and reported hallucinations. However, the judge ruled no new medical evidence was presented to justify another formal review.

The Goshen News says a psychologist has still been ordered to conduct an additional evaluation.

Garcia is accused in the December 2024 death of the child, who suffered severe head injuries. His jury trial remains scheduled for June 1, with a status hearing set for May 7.
