Elkhart police officers found legally justified in fatal shooting

The Elkhart County Prosecutor’s Office has determined that two Elkhart police officers were legally justified in the fatal shooting of a 17-year-old at High Dive Park in February. 

The decision follows an investigation by the Elkhart County Homicide Unit.

Prosecutors say forensic video analysis showed the teen fired a shot toward Officer Breneman before both officers returned fire in an exchange that lasted about three seconds.

No criminal charges will be filed.

The officers remain on administrative leave while the Elkhart Police Department reviews whether their actions complied with department policy.
