Former daycare worker Jackie Rolston files appeal of prison sentence

She’s not satisfied and wants a new sentence.

Jackie Rolston is appealing her 28 years in prison, 2 years probation sentence in Elkhart Circuit Court, according to court documents.

After a mistrial, Rolston was finally convicted of battery resulting in the death of a child on Nov. 30. Authorities say she was responsible for the brain injuries that lead to 19-month-old Kirk Coleman’s death.

Kirk Coleman’s family told The Elkhart Truth that they’re relieved justice has been served.

“Now we have justice for our baby,” said Coleman’s grandmother Angie Garza. “He can rest in peace.”

Initially, Rolston told police in Oct. 2014 that Coleman was choking on his lunch. But Coleman died hours later, and a coroner ruled he died of blunt force injuries.

Rolston was convicted of neglect of a dependent in a previous case. However, Coleman’s family wasn’t informed by Rolston of that at the time.

The family has since worked to get Kirk’s Law passed, which requires the creation of a database of people convicted of child abuse. That database must be up and running by July 1, 2017.
