An Elkhart man is appealing his sentence he received after he was arresting for having sex with a Niles, Mich., girl who lied about her age.

Zach Anderson was sentenced in April to 90 days in Berrien County Jail, five years on probation and 25 years on Michigan’s sex offender registry, the South Bend Tribune reported. As part of his sentence, Anderson also can’t use the internet or live in a home where internet access is available, including on smartphones — which meant Anderson had to stop pursuing a computer-related degree in college.

The sentencing came after Anderson met a girl in the over 18 section of Hot or Not, an online dating app ran by Facebook. Anderson was 19 at the time and the girl told him that she was 17, the Tribune reported.  Anderson didn’t find out until after the two had sex that the girl was only 14.

The girl and her mother asked Berrien County District Court Judge Dennis Wiley to be lenient on Anderson, the Tribune reported. The girl said that she doesn’t think anything should happen to Anderson and her mother requested that Wiley drop the case. But Wiley disagreed.

Anderson’s father, Lester Anderson, called in to The Casey Hendrickson Show on Tuesday, May 19, to talk about his son’s case. Listen to the full podcasts above to hear what Lester Anderson said. Read more about the case in the full story from the South Bend Tribune.
