COLDWATER, Mich. (AP) — An 80-year-old Michigan prisoner and his daughter-in-law are accused of conspiring to fool the government into sending more than $260,000 in Social Security benefits.

David McPeters is serving a life sentence for murder. An indictment filed Thursday in federal court says Kathryn McPeters filed an application for him for Social Security in 2006, using her Battle Creek address. Prisoners don’t qualify.

When a government representative followed up with a phone call, someone else posed as David McPeters.

The indictment says Kathryn McPeters would put $300 to $500 into her father-in-law’s prison account for spending and keep the rest.

She could not be reached for comment Friday. No phone number is listed for her.

David McPeters was convicted of murder in 1991 in Kalamazoo County. He’s in a prison in Coldwater.
