An Elkhart father says he “handled the situation poorly” when he smashed his 3-year-old son’s head against a rear windshield.

That’s according to court documents released in the case of Virgil Jones, 25. He’s admitted to smashing his son’s head “at least once” against the rear windshield. It was enough to shatter the windshield, according to the Elkhart Truth.

In the court documents, Jones says he was running late when he loaded his 1-year-old and 3-year-old boys into his 1998 Honda Civic. Jones shares custody of the children with their mother, alternating weeks of custody since the two separated in the summer.

The youngest child started crying, and the oldest child also started crying. That was enough to get Jones to snap. Jones jerked the kid back and forth repeatedly, eventually blacking out himself briefly, according to court documents.

Court documents also say Jones told the mother “I got mad” when she noticed the shattered window, bloody shirt, and bleeding from the back of the 3-year-old’s head. Jones eventually went to work, and the child eventually went to Riley Children’s Hospital. He was released in good health on Thursday.

Jones is initially charged with a level 3 felony charge of battery causing serious bodily injury to a child younger than 14. As of Friday, he was still in custody at Elkhart County Correctional Facility with a $100,000 bond. He’s due in court on Dec. 8.
