Attorneys for Wayne Kubsch request change of venue in third triple murder trial

A Mishawaka man about to be retried for a third time in a triple murder case wants his trial to take place away from St. Joseph County.

49-year-old Wayne Kubsch appeared via video conference Friday as his defense requested a change of venue to a different county. The judge gave his defense team until March 16 to make the formal request, after which the state will make a determination by the next court date of April 6.

Kubsch has been convicted twice of killing his wife, Beth Kubsch, her ex-husband Rick Milewski and her 10-year-old son Aaron Milewski in 1988. He’s been sentenced to the death penalty twice after a trial and retrial.

He’s being retried for the third time when an appeals court ruled jurors weren’t shown a piece of evidence.
