The family of the 22-year-old mother of two who was hit and killed by a former South Bend police officer, has filed a wrongful death lawsuit against the officer and the city.

The South Bend Tribune reports the lawsuit alleges Justin Gorny was negligent in his actions and that the city did not properly train him, which led to Erica Flores’ death back last summer.

Gorny was responding to a call at a high rate of speed on July 20, 2018, when he struck Flores.

Gorny was fired in November, despite having been previously cleared of criminal charges after a grand jury chose not to indict him on reckless homicide.
