Some victims and families of victims of a fatal August 2017 hit-and-run crash in Elkhart are suing the city.

Three people were killed, one of them a baby, and two others injured when a motorist jumped the curb and struck them on a sidewalk on Beardsley Avenue near Cassopolis Street.

The suit alleges the city was aware the sidewalk’s safety at the intersection was a recurring problem the city was aware of, and they failed to act.

It alleges that proper warning signs for drivers would have likely prevented the tragedy.

Leonard Grosswiler was sentenced to 10 years in prison for the crash.
