Ball State student suing University’s board of trustees after dorm attack

A student at Ball State University is suing the university’s board of trustees.

He says he was attacked last year in his dormitory, and a resident assistant hadn’t been assigned to the floor when it happened. The lawsuit is accusing Ball State of failing to protect him.

Nolan Akridge got a concussion, broken nose and a severely lacerated tongue during the attack at the LaFollette complex.

The lawsuit says that on Nov. 2, 2019, Akridge left his room and walked to a lounge to asked a group of people there if they could be quieter. The group was made up of a student, and four to five men who didn’t go to the university.

The men were drinking alcohol, according to the suit, and when Akridge told them to be quiet one of the people stood up and began shouting at him.

Akridge went to his room, while the other student took his guests to his room.

The suit says someone yelled a racial slur, and when Akridge opened his door again, the man who yelled at him, “stormed up to him and stuck him in the right eye,” the caused Akridge’s head to bound off the metal doorway.

Witnesses said Akridge was hit three times, and another student drove him to the hospital.

The lawsuit says the university didn’t have a resident assistant assigned to the floor for several weeks, and failed to monitor non-residents. The suit is seeking damages for pain, medical expenses, emotional distress and permanent impairment because it was Akridge’s third concussion.

A spokesperson told the Muncie Star Press that Ball State does not “comment on litigation or threats of litigation.”
