There is a growing number of Democrats who are coming out against President Biden’s decision not to renew Title 42.

The measure was enacted under the Trump Administration as part of the 1944 Public Health Services Law, which allows the United States to expel certain people or keep certain people from entering the country from out nations where communicable diseases are prevalent.

Republicans, such as Sen. Mike Braun of Indiana, feel once the order is lifted come May 23 there will be a huge surge in illegal immigration at the southern border.

“I and about 17 other Republican senators were there a year ago,” Braun told Fox Business. “It was going from 40,000 to 50,000 (encounters with illegal immigrant), record lows. Now you look at the stats … it was close to 300,000. Some predict it could get 50-percent above that.”

Six Democratic senators and four Democratic members of the House have publicly denounced the White House’s push to end Title 42. One of those Democrats is centrist Rep. Harry Cuellar (D-TX), who says he’s told the White House several times that he needs to prioritize border communities on the issue of illegal immigration.

There is also the political side of things, especially it being an election year. Many Democrats are fearful that if Title 42 is ended it could also mean the end of many Democrats’ time in Congress.

“The messaging can be terrible for Democrats if they don’t play this or message this right,” Cuellar told CBS News. “They’ll fit into the narrative that Republicans say – that Democrats are for open borders.”

“It’s a big midterm election issue,” Braun said. “If they insist upon doing it, which that announced it to be done in six weeks, it’s digging the hole deeper for Biden and he’s taking a bunch of senators with him.”

Some lawmakers have threatened to hold up COVID relief funds unless the president changes his mind on Title 42. The Senate Majority Leader is warning Republicans against doing that.

New York Democrat Chuck Schumer said the relief package was negotiated in good faith and should not be held “hostage” to vote on an amendment to reinstate Title 42. Senate Minority Leader Mitch McConnell has said he will insist on a vote for the amendment.

Only because they know if Biden further opens the border their jobs are in severe jeopardy, as they should be for not insisting on their administration obeying the law.
