Michigan judge blocks county prosecutors in abortion ban battle

A judge in Michigan says prosecutors cannot enforce the state’s 1931 abortion ban.

Friday, the judge blocked county prosecutors who are seeking to enforce the state’s 1931 ban on abortion “for the foreseeable future” after two days of witness testimony from abortion experts. The ruling follows a state Court of Appeals decision earlier this month stating county prosecutors were not covered by an order in May and could enforce the prohibition.

State Attorney General Dana Nessel issued a statement on the ruling, saying there is no doubt the state criminalizing abortion is in direct conflict with the ability of the medical community to provide the standard of care consistent with their education, training, expertise and oath.

Governor Whitmer said she is “grateful for this ruling,” which she says will protect women and ensure nurses and doctors can keep caring for their patients.
