South Bend Redevelopment Commission suing developer for contract breach

It’s official. The South Bend Redevelopment Commission is suing developer Dave Matthews for failing to build and open a full-service grocery store and pharmacy on the ground level of the apartment high rise at 300 East LaSalle Avenue.
According to the lawsuit, the commission insists Matthews failed to open both and has breached his contract after multiple deadlines.
Meantime, the South Bend Tribune reports the Regional Development Authority is waiting on Matthews’ response to a written notice that he breached his contract with that organization.
A letter sent Jan. 12 by Stephen Studer, the RDA’s attorney, informed Matthews he has 30 days to “cure the material breaches” of an unfinished grocery store and pharmacy. Otherwise, he must reimburse the RDA or potentially face another lawsuit.
