A Missouri man is facing jail time after allegedly shooting and killing a Niles man last month.
According to the probable cause statement, police were called to the victim’s Niles home on Sep. 30 when two people came out with their hands up, and another man was found shot dead in the home.
The other man at the home, Michael White, stated that 29-year-old James Perry and the victim, Luke Botica, had been arguing over pills and money.
When Botica went to the door to spit out some tobacco, White says Perry approached Botica, pointing a gun at him.
White said that Botica did not have a weapon in his hands and that Perry fired one shot that hit him in the head.
Leader Publications says that Perry is facing four felony charges, and a preliminary hearing in the case could be held next Tuesday, Oct. 17 if he does not waive a hearing at his court appearance Wednesday.
He is currently being held in the Berrien County Jail.
