Probate Court issues notice to litigants regarding judicial conduct violations

Newly-elected Probate Court, Judge Loris Zappia announced a significant development affecting 862 litigants whose cases were overseen by former Magistrate Aric Rutkowski from June 2021 to December 2022. The court has issued notices to these individuals, advising them of potential grounds to seek further review of their cases.
The notice informs litigants that during the administration of their cases, Magistrate Aric Rutkowski violated the Indiana Code of Judicial Conduct by engaging in a relationship with a deputy prosecutor assigned to their cases. The court emphasizes that such conduct may have impacted the litigants’ rights and recommends consideration of seeking further review before the court. While litigants have the option to pursue this independently, consulting with legal counsel is encouraged.
On May 29, 2025, Aric Rutkowski resigned from his position as Magistrate of the St. Joseph Probate Court, citing violations of Indiana Code of Judicial Conduct Sections 1.1 and 1.2 during the aforementioned period. The resignation, effective immediately, was accepted by Judge Loris Zappia, who assumed office on January 1, 2025, with a commitment to restoring public trust in the Probate Court.
Judge Zappia has taken proactive steps to address the issue, ensuring transparency in court operations by mandating the issuance of notices to affected litigants. This measure aims to uphold the integrity of the judicial system and promote accountability.
