Partial ruling made in South Bend Police tapes case

A partial ruling has been handed down in the South Bend Police tapes case.

And in doing so, the St. Joseph County Judge has rejected an attempt to dismiss the case filed by the group of police officers whose voices are recorded on the tapes.

The South Bend Tribune reports that judge ruled that the recordings, which were made before the department’s communications director discovered that the line was being taped, were not intentionally made and therefore did not violate the Indiana Wiretap Act.

There are still legal questions to be sorted out regarding the timing of the recordings, and any possible consent to be recorded.

The next hearing is scheduled for next week.
