Federal judge dismisses lawsuit filed by family of Eric Logan

A federal judge has dismissed the lawsuit filed by the family of Eric Logan against the officer who fatally shot him and the city of South Bend.

Logan’s family filed the lawsuit after former Police Sergeant Ryan O’Neill shot and killed Logan in June of 2019.

The family’s lawsuit alleged Sgt. O’Neill used excessive force and violated Logan’s civil rights, alleged misconduct by the officer.

The judge’s ruling stated that Logan posed in that instant an immediate threat of death or serious bodily injury.

Adding that O’Neill acted reasonably under the law based on all the information available to him in that moment.

The judge said the decision might be different if the facts were different, but the record offered no proof of the different facts.
